ÇALIŞMAYA BURADA VERİLEN HAKLARI UYGULAYARAK, İŞBU LİSANSIN ŞARTLARIYLA SINIRLI OLDUĞUNUZU KABUL ETMİŞ SAYILIRSINIZ. İŞBU LİSANS BİR KONTRAT OLARAK DÜŞÜNÜLDÜĞÜ TAKDİRDE, LİSANS SAHİBİ BURADAKİ HÜKÜMLER VE KOŞULLARI KABUL ETTİĞİNİZİ DÜŞÜNEREK SİZE BURADAKİ HAKLARI VERİR.

1. Tanımlar  

a. “Uyarlama”, çalışmaya dayalı ya da çalışmaya ve daha önceden var olan diğer çalışmalara dayalı bir başka çalışmanın, örneğin çeviri, uyarlama, türev çalışma, müzik düzenlemeleri ya da edebi veya diğer sanatsal çalışmalardaki değişiklikler, ya da fonogram ya da performans ve sinematografik uyarlamalar veya çalışmanın yeniden düzenlenebildiği, aktarılabildiği, ya da uyarlanabildiği biçimler de dahil olmak üzere, özgün çalışmadan türetildiği açıkça belli olan biçimlerin tümü olup; çalışma bir koleksiyonu oluşturan parçalardan biriyse işbu lisans gereği uyarlama sayılmaz. Şüpheye yer bırakmamak adına, çalışma bir müzik çalışması, bir performans ya da fonogram ise, çalışmanın hareket eden bir görüntüyle zaman ilişkili olarak eşzamanlanması (“synching”) işbu lisans gereği adaptasyon kabul edilecektir.

b. “Koleksiyon”, edebi ya da sanatsal çalışmaların, örneğin ansiklopedi ya da antolojiler, ya da performanslar, fonogramlar ya da yayınlar, veya diğer işler veya aşağıda 1(f) bölümünde içeriklerinin seçimi ve düzenlenmesi sebebiyle fikri eser oluşturan, çalışmanın tamamının değiştirilmeden bir ya da daha fazla katkıyla dahil edildiği, herbiri kendi başına ayrı ve bağımsız işler olup biraraya gelerek ortak bir toplulukta birleşen, listelenmiş işlerin dışındaki konulardır. Bir koleksiyon oluşturan çalışma işbu lisans altında uyarlama olarak (yukarıda tanımlandığı gibi) görülmez.

c. “Dağıtmak”, çalışmanın ya da uyarlamanın özgün halini ya da kopyalarını uygun şekilde, satmak ya da diğer sahiplik aktarımı yollarıyla kamuya açık duruma getirmektir.

d. “Lisans veren”, işbu lisans altında çalışmayı sunan kişi, kişiler, kurum ya da kuruluşlardır.

e. “Özgün Yazar”, edebi ya da sanatsal bir çalışma söz konusuysa, çalışmayı yaratan kişi, kişiler, kurum ya da kuruluşlar, veya belirli bir kişi ya da kuruluş yoksa yayımcı olmak üzere, ayrıca (I) bir performans ise aktör, şarkıcı, müzisten, dansçı ve oynayan, söyleyen, aktaran, seslendiren, rol alan, yorumlayan, ya da bir halk biliminin edebi ya da sanatsal çalışmalarını ya da ifadelerini icra eden, (ii) bir fonogram ise, bir performansın ya da diğer işitsel öğelerin seslerini ilk toplayan kişi, ya da yasal kişilikler olarak yapımcılar, ve “yayınlar söz konusuysa yayını sunan kuruluştur.

f. “Çalışma”, işbu lisans altında sunulan, edebi, bilimsel ya da sanatsal hiçbir alan kısıtlaması olmaksızın üretilen, hangi tarzda ya da ifade biçiminde üretilirse üretilsin, sayısal biçimler de dahil olmak üzere, örneğin kitap, el ilanı ve diğer yazılar gibi, bir ders anlatımı, konuşma, söylev, ya da aynı türde diğer çalışmalar; dramatik ya da dramatik-müzikal tarzı çalışmalar; kareografik çalışmalar ya da sessiz sahne çalışmalarındaki eğlenceler; sözlü/sözsüz müzikal kompozisyonlar; sinemacılığa benzer bir süreçle ifade edilen sinematografik çalışmalara benzetilmiş çalışmalar; çizim, boyama, mimarlık, heykel, oymacılık ya da taş baskı çalışmaları; fotoğrafçılığa benzer bir süreçle ifade edilen fotoğrafik çalışmalara benzetilmiş çalışmalar; uygulamalı sanat çalışmaları; coğrafya, topoğrafya, mimarlık ya da bilimle ilgili bir çizim, harita, plan, taslak ya da üç boyutlu çalışma; bir performans; bir yayın; bir fonogram; telif hakkı alınabilir bir çalışma olarak korunan bir veri derlemesi; ayrıca bir edebi ya da sanatsal çalışma olarak nitelendirilmediği ölçüde çeşitli kişilerce veya sahne sanatçısı tarafından sahnelenen çalışmalardır.

g. “Siz”, işbu lisansta belirtilen hakları kullanan, çalışma bakımından işbu lisansın hükümlerini daha önce ihlal etmemiş, ya da daha önceki bir ihlale rağmen, işbu lisanstaki hakların kullanımı konusunda lisans verenden açıkça bir izin almış kişi ya da kuruluşları ifade eder.

h. “Kamuya Açık İcra Etmek”; kablolu ya da kablosuz araçlar ya da kamuya açık dijital performanslar da dahil her türlü yol ve süreçle, çalışmanın kamuya anlatımını gerçekleştirmek ve bu kamuya anlatımı halka iletmek; çalışmaları kamuya kamuoyunun kendi seçtikleri bir yerde ya da bir yerden erişebilecekleri şekilde sağlamak; kamuya açık dijital performanslar da dahil olmak üzere çalışmayı kamuya her türlü yol ve süreçle icra etmek ve çalışmanın icrasını kamuya iletmek; simgeler, sesler ya da görüntüler de dahil olmak üzere her türlü yoldan çalışmayı yayınlamak ya da yeniden yayınlamak anlamına gelir.

i. “Yeniden üretmek”, dijital biçimde veya diğer elektronik ortamlardaki korunan bir performansı ya da fonogramın depolaması da dahil olmak üzere, çalışmayı bir ses ya da görsel kayıtlarla kısıtlı olmaksızın ve sabitleme hakkı ile çalışmanın sabitlemesini yeniden üretmek dahil her yolla kopyalamak anlamına gelir.

2. Adil Davranma Hakkı. İşbu lisanstaki hiçbir husus, telif hakkı yasası ya da yürürlükteki diğer yasaların korumasındaki teliflerle bağlantılı olarak sunulan kısıtlama ve istisnalardan doğan telif ya da haklardan bağımsız kullanımları azaltmaya, sınırlamaya ya da kısıtlamaya yönelik değildir.

3. Lisans Vermek. İşbu lisansın hükümleri ve koşullarına bağlı olarak, aşağıda belirtildiği üzere çalışma üzerindeki hakları kullanmanız için lisans sahibi size dünya çapında, telif ücreti olmayan, belli birine ait olmayan, (uygulanabilir telif hakkı süresince) sürekli bir lisans vermektedir:

a. Çalışmayı yeniden üretmek, bir ya da daha fazla koleksiyona dahil etmek, koleksiyona dahil edildiği haliyle yeniden üretmek;

b. Herhangi bir ortamdaki herhangi bir çevirisi de dahil olmak üzere, özgün çalışmada yapılan değişiklikleri açıkça etiketlemek, ayırmak ya da farklı bir şekilde belirlemek için girişimde bulunan bir uyarlamanın yaratılması ya da yeniden üretilmesi. Örneğin, bir çeviri “Özgün metin İngilizice’den İspanyolca’ya çevrilmiştir.” şeklinde etiketlenebilir ya da yapılan değişiklikte “Özgün metin değiştirilmiştir.” şeklinde bir ibare içerebilir;

c. Bir koleksiyona dahil edilen hali de dahil olmak üzere bir çalışmayı dağıtmak ve kamuya açık icra etmek;

d. Uyarlamaları dağıtmak ve kamuya açık icra etmek.

e. Şüpheye yer bırakmamak adına:

1. Vazgeçilemez Zorunlu Lisans Şemaları. Herhangi bir yazılı ya da zorunlu lisanslama şeması yoluyla ücret toplama hakkından vazeçilemeyen yetkilerde, lisans veren kişi sizin tarafınızdan işbu lisans yoluyla verilen hakların kullanılmasından kaynaklanan ücretleri toplama özel hakkını saklı tutar ; ve,  
2. Vazgeçilebilir Zorunlu Lisans Şemaları. Herhangi bir yazılı ya da zorunlu lisanslama şeması yoluyla ücret toplama hakkından vazeçilebilen yetkilerde, lisans veren kişi sizin tarafınızdan işbu lisans yoluyla verilen hakların kullanılmasından kaynaklanan ücretleri toplama özel hakkından vazgeçer; ve,  
3. Gönüllü Lisans. Lisans veren kişi sizin tarafınızdan işbu lisans yoluyla verilen hakların kullanılmasından kaynaklanan ücretleri bireysel olarak ya da lisans sahibinin gönüllü lisans şemalarını yöneten toplumlara dahil olduğu durumlarda o toplum tarafından toplama özel hakkından vazgeçer.

Yukarıda bahsi geçen haklar, şu anda bilinen ya da daha sonra tasarlanacak tüm medya ve formatlara uygulanabilir. Yukarıda bahsedilen haklar, diğer medya ve formatların haklarının kullanılması için gerekli teknik değişiklikleri yapabilme hakkını da içerir. Kısım 8(f)ye ilişkin, lisans veren tarafından açıkça verilmeyen tüm haklar burada korunmaktadır.

4. Kısıtlamalar. Yukarıda Kısım 3′te verilen lisans aşağıdaki kısıtlamalara açıkça bağlanmış olup bu kısıtlamalarla sınırlıdır: a. Çalışmayı yalnızca işbu lisansın şartları altında dağıtabilir veya kamuya açık icra edebilirsiniz. Dağıttığınız ya da kamuya açık icra ettiğiniz her bir çalışmaya işbu lisansın bir kopyasını ya da işbu lisans için bir Tekdüzen Kaynak Tanımlayıcısı (URI) iliştirmelisiniz. İşbu lisansın şartlarını kısıtlayan ya da işu lisans altında işi elde eden alıcıya verilen hakların o kişi tarafından kullanılmasını kısıtlayıcı herhangi bir şart öneremez ya da dayatamazsınız. Çalışmayı alt lisansla kullanamazsınız. İşbu lisanla ve dağıttığınız ve kamuya açık icra ettiğiniz çalışmanın her kopyasıyla gelen haklarından vazgeçenler kısmıyla ilgili tüm uyarıları değiştirmeden korumalısınız. Çalışmayı dağıttığınızda ya da kamuya açık icra ettiğinizde, çalışmayı sizden temin eden alıcıların işbu lisans altında elde ettiği hakları kullanma yetisini kısıtlayan herhangi bir etkili teknolojik bir kısıtlamayı o çalışmaya dayatamazsınız. İşbu 4. Kısım, çalışmanın bir koleksiyonla birleştirilmiş haline uygulanır, ancak bu durum çalışmadan bağımsız olarak koleksiyonun işbu lisansla ilişkili olmasını gerektirmez. Eğer bir koleksiyon oluşturduysanız, herhangi bir lisans veren kişinin uyarısı üzerine sizden talep edilirse uygulanabilir ölçüde Kısım 4(b)nin gerektirdiği gibi her türlü katkıda bulunanlar listesini koleksiyondan kaldırmak zorundasınız. Eğer bir uyarlama oluşturduysanız, herhangi bir lisans veren kişinin uyarısı üzerine sizden talep edilirse uygulanabilir ölçüde Kısım 4(b)nin gerektirdiği gibi her türlü katkıda bulunanlar listesini uyarlamadan kaldırmak zorundasınız. b. Bir çalışmayı, ya da uyarlamalarını veya koleksiyonlarını dağıttığınızda veya kamuya açık icra ettiğinizde, Kısım 4(a)ya uygun bir talepte bulunulmadıysa, çalışma için yapılan tüm telif hakkı uyarılarını değiştirmeden korumalı, ve ortama ve yere uygun olarak şunları sağlamalısınız: (i) verildiyse özgün yazarın adı (ya da uygunsa takma adı), ve/veya özgün yazar ve/veya lisans veren kişi tarafından üçüncü şahıs/şahısların (örn. sponsor bir kurum, yayın kuruluşu, gazete) adlarının geçmesi için (“Atfedilen Taraflar”) lisans verenin telif hakkı uyarısında, hizmet şartlarında veya diğer uygun araçlarda tayin edilmişse, bu taraf ya da tarafların adları; (ii) verildiyse çalışmanın adı; (iii) eğer çalışmanın telif hakkı uyarısına ya da lisanslama bilgisiyle ilgiliyse; icrası uygun olduğu ölçüde, eğer varsa, lisans verenin çalışmaya iliştirilmesini açıkça belirttiği URI; ve (iv) bir uyarlama söz konusuysa Kısım 3(b)ye uygun olarak, çalışmanın bir uyarlamada kullanıldığını belirten bir katkıda bulunanlar listesi (örn. “Çalışmanın Özgün Yazarı Tarafından Yapılan Fransızca Çevirisi”ya da “Özgün Yazar Tarafından Yapılan Özgün Çalışmaya Dayanan Senaryo”). İşbu 4(b) Kısmı tarafından gerekli görülen katkıda bulunanlar listesi uygun bir yöntemle uygulanabilir; ancak uyarlama ya da koleksiyon söz konusuysa, ve eğer koleksiyona ya da derlemeye katkıda bulunan tüm yazarlar için bir tanıtım yazısı çıkacaksa, bu yazıların bir parçası olarak en azından katkıda bulunan diğer yazarlar için çıkan tanıtım yazısı kadar görünür şekilde çıkacaktır. Şüpheye yer bırakmamak adına bu bölüm gereğince kullanılan tanıtım yazısını sadece yukarıda bahsedildiği şekilde atfetmek amacıyla kullanabilirsiniz ve, işbu lisansla verilen hakları kullanarak, dolaylı ya da doğrudan, asıl yazarın, lisans verenin ve/veya atfedilen tarafların uygun görüldüğü şekilde sponsorluğu ya da desteğini, asıl yazarın, lisans verenin ve/veya atfedilen tarafların daha önce yazılı izin verdiğine dair ifadeleri olmadan sizinle ya da çalışmayı kullanmanızla bağlantısını kanıtlayamaz ya da ima edemezdiniz. c. Lisans veren tarafından yazılı olarak başka türlü kabul edilmediği takdirde ya da yasalarla başka bir şekilde izin verildiği durumlar haricinde, bir çalışmayı kendi başına ya da bir uyarlama veya koleksiyonun parçası olarak yeniden üretir, dağıtır veya kamuya açık icra ederseniz, asıl yazarın onuruna ve saygınlığına zarar vereceğinden, çalışmayı bozmamalı, zarar vermemeli, değiştirmemeli ve zarar verici diğer eylemleri gerçekleştirmemelisiniz. İşbu lisansın 3(b) bölümünde verilen hakların (uyarlama yapma hakkı) kullanılmasının bozmak, zarar vermek, değiştirmek veya asıl yazarın onuruna ve saygınlığına zarar verici eylemlerde bulunmak olarak addedildiği bazı yetki alanlarında (örn. Japonya), lisans veren kişi; uygun görüldüğü şekilde, sizin işbu lisansın 3(b) bölümü uyarınca verilen hakları (uyarlama yapma hakkı)gereği dışında olmaksızın makul bir şekilde kullanabilmenizi sağlamak için, yürürlükteki iç hukukun izin verdiği azami ölçüde işbu bölümden vazgeçecek ya da bölümü savunmayacaktır.

4. Beyanlar, Taahhütler ve Feragatlar YAZILI OLARAK TARAFLARCA KARŞILIKLI OLARAK BAŞKA TÜRLÜ KABUL EDİLMEDİĞİ SÜRECE, LİSANS VEREN ÇALIŞMAYI OLDUĞU GİBİ SUNAR VE ÇALIŞMAYA DAİR AÇIKÇA YA DA KAPALI OLARAK, YASAL YA DA BAŞKA TÜRLÜ BEYANDA YA DA TAAHHÜTTE BULUNMAZ OLUP, MÜLKİYET, TİCARİ ELVERİŞLİLİK, ÖZEL BİR AMACA UYGUNLUK, İHLAL ETMEME TAAHHÜTÜ DAHİL, VE BUNUNLA KISTLI OLMAKSIZIN, ANLAŞILIR OLSUN YA DA OLMASIN,GİZLİ YA DA DİĞER AYIPLARIN YOKLUĞU, KESİNLİK, YA DA HATALARIN OLMAYIŞI KONUSUNDA TAAHHÜT VERMEZ. BAZI YETKİ ALANLARI KAPALI TAAHHÜTLERİN HARİÇ TUTULMASINA İZİN VERMEZ: BÖYLE DURUMLARDA BU HARİCİYETLER SİZE UYGULANMAYABİLİR.
5. Yükümlülüklerin Kısıtlanması

YÜRÜRLÜKTEKİ BİR YASANIN GEREĞİ DIŞINDA, LİSANS VEREN HİÇBİR ŞART ALTINDA; İŞBU LİSANS DIŞINDA OLUŞAN YA DA ÇALIŞMANIN KULLANIMINDAN KAYNAKLANAN HERHANGİ BİR ÖZEL, TESADÜFİ, BİR ŞEY SONUCU OLUŞAN, CEZAİ YA DA ÖRNEK ALINACAK BİR HASARDAN, OLASI HASARLAR KONUSUNDA UYARILMIŞ OLMASI SÖZ KONUSU OLSA DAHİ, SİZE KARŞI HİÇBİR HUKUK KURAMINDA SORUMLU DEĞİLDİR.

4. İptal a. İşbu lisans ve burada size verilen haklar, yine işbu lisansın hükümlerinin tarafınızdan ihlali söz konusu olması durumunda kendiliğinden sonlanacaktır. Ancak, işbu lisans altında sizden uyarlama ve koleksiyonları alan kişi ya da kurumlar lisanslara tamamen uydukları sürece bu kişi ve kurumların lisansları sonlandırılmayacaktır. İşbu lisansın sonlanması durumunda 1, 2, 5, 6, 7 ve 8′inci bölümler geçerliliğini koruyacaktır. b. Yukarıda bahsedilen hükümler ve koşullarla ilgili olarak, burada sunulan lisans daimidir (çalışmadaki telif hakkının geçerli olduğu süre boyunca). Yukarıda bahsi geçen durumdan bağımsız olarak, ancakyapılacak bir seçimin işbu lisansı (ya da işbu lisansın hükümleri altında verilen ya da verilmesi gereken her türlü diğer lisansı) geri çekmeyi gerektirmediği, ve işbu lisansın yukarıda bahsedildiği gibi sonlandırılmadıysa aynen ve etkili olarak devamlılığını sürdürdüğü şartlarda, lisans veren kişi çalışmayı başka lisans hükümleriyle piyasaya sürme ve herhangi bir zamanda çalışmayı dağıtmayı bırakma hakkına sahiptir.  
5. Muhtelif a. Her defasında çalışmayı ya da bir koleksiyonu dağıttığınız veya kamuya açık icra ettiğinizde, lisans sahibi alıcılara çalışma için lisansın size sağladığı aynı hüküm ve koşullarla bir lisans sunar. b. Her defasında bir uyarlamayı dağıttığınız veya kamuya açık icra ettiğinizde, lisans sahibi alıcılara özgün çalışma için lisansın size sağladığı aynı hüküm ve koşullarla bir lisans sunar. c. İşbu lisansın hükümlerinden herhangi biri yürürlükteki yasa uyarınca geçersiz ya da uygulanamaz durumda ise, işbu lisansın geri kalan şartlarının geçerliliğini ve uygulanabilirliğini etkilemez, ve işbu anlaşmanın diğer taraflarının ek bir eylemi olmaksızın, böyle hükümler geçerli ve uygulanabilir olmaları için gerekli asgari değişikliklerle yeniden yapılandırılırlar. d. İşbu lisansın hiçbir hükmü vazgeçilmiş sayılamaz ve hiçbir ihlale, vazgeçme ve rızayla itham edilen tarafça bir feragat ya da onay yazılı olarak sunulmuş ve imzalanmış değilse, razı olunmaz. e. İşbu lisans burada lisanslanan çalışmaya ilişkin olarak taraflar arasındaki anlaşmanın tamamını oluşturur. Burada belirtilmeyen çalışmalarla ilgili herhangi bir hüküm, anlaşma ya da beyan bulunmamaktadır. Lisans veren için, sizin bildirmenizden doğacak herhangi bir ek hüküm bağlayıcı değildir. İşbu lisans sizinle lisans veren kişi arasındaki ortak yazılı bir anlaşma olmaksızın değiştirilemez. f. İşbu lisansla sunulan haklar ve ilgili konu; Bern Edebi ve Sanatsal Çalışmaları Koruma Anlaşması (28 Eylül 1979′da değiştirilen haliyle), 1961 Roma Anlaşması, 1996 WIPO Telif Hakkı Anlaşması, 1996 WIPO Performans ve Fonogram Anlaşması ve Uluslararası Telif Hakkı Anlaşması’nın (24 Temmuz 1971′de düzeltilen haliyle) terimleri kullanılarak tasarlanmıştır. Yukarıda bahsi geçen anlaşma hükümlerinin geçerli iç hukuktaki uygulanmasına ilişkin hükümlere göre, uygulama talebinde bulunulan lisans koşulları, ilgili yargı alanında geçerlidir. Eğer yürürlükteki telif hakkı yasası altında verilen standart hakların işbu lisans altında verilmeyen ek haklar içerdiği bir durum söz konusuysa, bu gibi ek haklar işbu lisansa dahil sayılır; işbu lisans yürürlükteki bir yasa altındaki hiçbir hakkın lisansını kısıtlama amacı gütmez.

Creative Commons Uyarısı

Creative Commons işbu lisansın taraflarından değildir, ve çalışmayla bağlantılı herhangi bir garanti vermez. Creative Commons her türlü genel, özel, kazai ya da bir şey sonucu oluşan hasarlar da dahil olmak üzere ve bununla kısıtlı olmaksızın, işbu lisansla bağlantılı olarak oluşacak herhangi bir hasardan dolayı size veya bir üçüncü tarafa karşı hiçbir hukuk kuramında yükümlü değildir. Yukarıda geçen iki (2) cümleden bağımsız olarak, eğer Creative Commons burada kendisini açıkça lisans veren olarak tanımlarsa, lisans verene ait her türlü hak ve yükümlülüğün sahibidir.

Kamuya, çalışmanın CCPL ile lisanslandığını bildirmek gibi sınırlı bir amaç dışında, Creative Commons hiçbir taraf yoluyla “Creative Commons” markasının, Creative Commons markasıyla ilişkili marka ya da logonun Creative Commons tarafından daha önce verilmiş yazılı bir onay olmaksızın kullanılmasına izin vermez. İzin verilen kullanımlar Creative Commons’ın bu satırlar yazılırken geçerli olan, İnternet sitesinde yayımlanan veya zaman zaman istek üzerine sağlanan ticari marka yönetmeliğine uygun olacaktır. 6. Limitation on Liability. Creative Commons Notice
